1. Purpose and Scope

This Trade Marks & Intellectual Property Rights Policy (the "Policy") sets out how the intellectual property of the Money Protects group is owned, protected, licensed and enforced worldwide, and the terms on which visitors, clients, partners, media and other third parties may refer to or use it.

It applies to moneyprotects.com and all sub-domains, the Money Protects mobile and web applications, the OptimizerAI and MONIDR platforms, the Knowledge Centre, brochures, term sheets, presentations, videos, voice content, and every other work, mark, structure or system published or operated by a Money Protects entity (together, the "Money Protects IP").

By accessing any Money Protects property you agree to this Policy, which forms part of our Terms and Conditions and should be read together with our Disclaimer and Privacy Policy.


2. Who Owns the Money Protects IP

Unless expressly stated otherwise, all Money Protects IP is owned by, or exclusively licensed to, Money Protects Capital Limited ("MPCL"), a firm regulated by the Dubai Financial Services Authority in the Dubai International Financial Centre (DFSA Regulated · DIFC · Category 3C License #7741). MPCL is the originating owner of the group's structured-finance intellectual property.

The following group entities use the Money Protects IP under licence from MPCL, within their own jurisdictions and regulatory perimeters:

  • Money Protects Financial Services L.L.C ("MPFS") — United Arab Emirates (onshore).
  • Money Protects India Private Limited ("MPI") — India, an advisory, technology and research company.

References in this Policy to "Money Protects", "we", "us" or "our" are to MPCL and, where the context requires, to the relevant licensed group entity. Nothing in this Policy grants any person an ownership interest in any Money Protects IP.


3. Categories of Protected Intellectual Property

Money Protects IP includes, without limitation, the following, whether or not registered and in every jurisdiction in which protection is available:

  • Trade marks, service marks and trade names — word marks, logos, the Money Protects shield device, product names, taglines, colour combinations and the overall look and feel of our brand (see Section 4).
  • Proprietary financial structures and methodologies — the design, mechanics, documentation, models and naming of our structured products and advisory frameworks (see Section 5).
  • Copyright works — website content, text, graphics, photographs, illustrations, animations, video, audio and voice content, brochures, term sheets, research, articles, presentations, training material, user-interface designs and the selection and arrangement of all of the foregoing.
  • Software and artificial-intelligence systems — source and object code, algorithms, models, prompts, scoring logic, databases, APIs, integrations and outputs of the OptimizerAI engines, the Money Protects App and the MONIDR platform (see Section 6).
  • Trade secrets and confidential know-how — pricing and structuring logic, risk models, client and counterparty methodologies, operating procedures and any information marked or reasonably understood to be confidential.
  • Domain names and digital identifiers — including moneyprotects.com, monidr.ai, monidr.com and associated social-media handles.
  • Designs and get-up — the distinctive visual presentation of our digital properties and printed materials.

4. Schedule of Trade Marks

The marks below are trade marks of MPCL (or its licensors), protected under the laws of the UAE, the DIFC, India and other jurisdictions, whether by registration, pending application, or by use and reputation. The absence of a mark from this schedule, or of the ™ symbol from any particular use, is not a waiver of our rights.

All other names, logos and marks appearing on our properties are the property of their respective owners and are used for identification only (see Section 11).


5. Proprietary Financial Structures and Methodologies

MESP — Mortgage EMI Sleeping Period™, ERDR — Equity Release–Double Rental™ and FEFL — Fixed EMI for Life™ are original structured products conceived and developed by Money Protects and offered as DFSA-approved products under MPCL's approved Regulatory Business Model for Professional Clients. Each is protected as a combination of:

  • copyright in the product documentation, cash-flow models, term-sheet architecture, illustrations and explanatory material;
  • trade marks in the product names, acronyms and associated branding; and
  • trade secrets in the underlying structuring, pricing and risk logic.

No person may, without our prior written consent, replicate, adapt, white-label, reverse-engineer, re-name or market any financial product, service or programme that reproduces these structures or their distinctive features, or that uses names, acronyms or descriptions likely to be confused with them. Use of a different name for a substantially identical structure does not avoid infringement.

Product information published on this website is provided for the evaluation of our services by prospective Professional Clients and does not constitute a licence to use the underlying methodology.


6. Software, Artificial Intelligence and Data

The OptimizerAI engines, the Money Protects App, the MONIDR platform (including its voice and conversational agents) and every associated model, prompt, dataset, interface and output are proprietary to Money Protects.

  • Use of outputs. Reports, scenarios, term-sheet drafts and other outputs generated for you are licensed to you for your own internal evaluation only. They may not be republished, resold, incorporated into third-party products or represented as your own work.
  • No automated extraction. You may not scrape, crawl, harvest, mirror, bulk-download or use any automated means to extract content, code or data from our properties, nor use any of our content or outputs to train, fine-tune, evaluate or benchmark a machine-learning or AI model.
  • No reverse engineering. You may not decompile, disassemble, reverse-engineer, probe or attempt to derive the source code, models, prompts or logic of any Money Protects system, or circumvent any technical protection.
  • No derivative systems. You may not build, or assist others to build, a product or service that reproduces the functionality, workflow or distinctive presentation of our systems.

7. Permitted Use

Subject to this Policy, you may:

  • view our website and download brochures and public documents for your personal, non-commercial evaluation of our services;
  • print or store single copies of pages for the same purpose, keeping all proprietary notices intact;
  • quote short extracts of our published articles and insights for comment, criticism, review or news reporting, with clear attribution to "Money Protects" and a link to the original page;
  • link to our home page or to any public page using its plain URL, provided the link is not framed and does not imply endorsement or partnership; and
  • refer to Money Protects and our products by their correct names in factual, non-misleading contexts (see Section 9).

Any other use, including any commercial use, requires our prior written permission.


8. Prohibited Use

Without our prior written consent you must not:

  • reproduce, distribute, publish, transmit, display, adapt, translate or create derivative works from any Money Protects IP, other than as permitted in Section 7;
  • use any Money Protects mark, or any confusingly similar mark, in a business name, product name, domain name, social-media handle, keyword advertising, hashtag or metadata;
  • alter, animate, distort, recolour or combine our logos or marks with other marks, words or designs;
  • use our marks or content in a manner that is false, misleading, disparaging, defamatory, obscene or that suggests sponsorship, affiliation, approval or regulatory status that does not exist;
  • remove, obscure or alter any copyright, trade-mark or other proprietary notice;
  • frame, embed or in-line link our pages, media or applications within any other site or application;
  • use our content, brochures, term sheets or product descriptions to market, promote or structure competing products; or
  • register, or attempt to register, any Money Protects mark, or any confusingly similar mark, design or domain name, anywhere in the world.

9. Brand and Trade Mark Usage Guidelines

Where you are permitted to refer to us, please observe the following:

  • Use our marks as adjectives with the correct capitalisation and, on first mention, the ™ symbol: for example "the MESP — Mortgage EMI Sleeping Period™ product".
  • Use the full product names on first mention. The acronyms MESP, ERDR and FEFL may be used thereafter.
  • Do not abbreviate, translate, pluralise or possessivise our marks, and do not use them as verbs.
  • Use only logo files supplied by us, unaltered and at the specified minimum size and clear-space, and never as part of your own logo.
  • Include the attribution: "Money Protects, MESP, ERDR, FEFL, OptimizerAI and MONIDR are trade marks of Money Protects Capital Limited."
  • Media, research and academic requests for logos, imagery or interviews should be directed to [email protected].

10. Licensing, Partners and Group Entities

Licences to use Money Protects IP are granted only in writing, are personal to the licensee, non-transferable and revocable, and are limited to the territory, purpose and term stated in the licence. Introducers, distribution partners, technology vendors and professional advisers receive no rights in Money Protects IP beyond those expressly granted in their agreement with us, and all goodwill arising from their use accrues to MPCL.

Group entities, including MPI in India, use the Money Protects IP under intra-group licence. A licence to a group entity does not extend the regulatory permissions of any other entity: regulated financial services are provided only by the entity licensed to provide them in the relevant jurisdiction.

On expiry or termination of any licence, all use of Money Protects IP must cease immediately and all materials bearing it must be returned or destroyed.


11. Third-Party Intellectual Property

We respect the intellectual property of others. Third-party names, logos, marks, software libraries, fonts, media and content appearing on our properties are the property of their respective owners, are used under licence or for identification only, and do not imply any affiliation with or endorsement of Money Protects. Where open-source or third-party components are used, we comply with their applicable licence terms.

Links to external websites are provided for convenience; we do not control and are not responsible for their content or intellectual-property practices.


12. Material You Submit to Us

If you submit material to us — including enquiries, feedback, suggestions, documents, CVs, or content posted through our channels — you retain ownership of it but grant Money Protects a worldwide, royalty-free, non-exclusive licence to use, store, reproduce and adapt it for the purpose for which it was submitted and for the improvement of our services. You warrant that you own or are authorised to submit the material and that it does not infringe any third-party rights. Personal data within submissions is handled in accordance with our Privacy Policy.

Unsolicited ideas or proposals concerning products, structures or technology are received on a non-confidential basis; we accept no obligation in respect of them and may already be developing similar concepts independently.


13. Reporting Infringement — Notice and Takedown

If you believe that Money Protects IP is being infringed, or that content on our properties infringes your rights, please notify us at [email protected] with the subject line "IP Notice". To enable us to act quickly, please include:

  • your name, organisation, postal address, email and telephone number;
  • identification of the work or mark concerned and evidence of your rights in it (or of Money Protects' rights, if reporting infringement of our IP);
  • the exact URL(s) or location of the allegedly infringing material;
  • a statement that you believe in good faith that the use is not authorised by the rights-holder, its agent or the law;
  • a statement, under penalty of law, that the information in the notice is accurate and that you are the rights-holder or authorised to act for them; and
  • your physical or electronic signature.

We will acknowledge valid notices, investigate, and where appropriate remove or disable access to the material, notify the party who posted it, and provide an opportunity for counter-notice. We may terminate access for repeat infringers. Knowingly submitting a false notice may expose you to liability.


14. Enforcement

We actively monitor and enforce our intellectual property rights worldwide. Unauthorised use may result in, without limitation:

  • cease-and-desist demands and requests for undertakings, delivery-up and destruction of infringing material;
  • takedown requests to hosting providers, registrars, search engines, app stores and social-media platforms;
  • domain-name dispute proceedings under the UDRP or equivalent national policies;
  • civil proceedings for injunctions, damages or an account of profits, and recovery of legal costs;
  • criminal complaints where counterfeiting, piracy or fraud is involved; and
  • reports to the DFSA or other regulators where our marks are misused to suggest false regulatory status or to solicit the public.

Failure to enforce any right on a particular occasion is not a waiver of that right.


15. Legal Framework

Money Protects IP is protected under, and this Policy is informed by, the following international and national instruments as applicable:

  • International: the Paris Convention for the Protection of Industrial Property; the Berne Convention for the Protection of Literary and Artistic Works; the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), including Article 39 on undisclosed information; the WIPO Copyright Treaty; and the Madrid System for the international registration of marks.
  • DIFC: DIFC Intellectual Property Law No. 4 of 2019 and its Regulations.
  • United Arab Emirates: Federal Decree-Law No. 36 of 2021 on Trademarks; Federal Decree-Law No. 38 of 2021 on Copyright and Neighbouring Rights; Federal Decree-Law No. 11 of 2021 on the Regulation and Protection of Industrial Property Rights; and Federal Decree-Law No. 34 of 2021 on Combatting Rumours and Cybercrimes, as applicable to online infringement.
  • India: the Trade Marks Act, 1999; the Copyright Act, 1957; the Designs Act, 2000; and the Information Technology Act, 2000.
  • Other jurisdictions: including the EU Trade Mark Regulation (EU) 2017/1001 and Directive 2001/29/EC; the UK Trade Marks Act 1994 and Copyright, Designs and Patents Act 1988; and the US Lanham Act (15 U.S.C. §1051 et seq.) and Digital Millennium Copyright Act (17 U.S.C. §512), to the extent our IP is used or infringed there.

16. Governing Law and Jurisdiction

This Policy and any dispute arising from it or from the use of Money Protects IP are governed by the laws of the Dubai International Financial Centre, and the DIFC Courts have exclusive jurisdiction, without prejudice to our right to seek injunctive or other relief in any jurisdiction where infringement occurs or where the infringer or its assets are located.


17. Changes to this Policy

We may update this Policy from time to time to reflect new products, marks, jurisdictions or legal requirements. The current version, with its effective date, is always published at this page. Continued use of our properties after a change constitutes acceptance of the updated Policy.
